Much has been written about the Defamation Act 2013, which came into force on 1 January 2014. On the one hand it is a “boost for free speech“, on the other a “missed opportunity“. The government’s line is that the new Act “rebalances the law on defamation to provide more effective protection for freedom of speech while at the same time ensuring that people who have been defamed are able to protect their reputation“. The recent judgment of the Supreme Court inThe Rugby Football Union v Consolidated Information Services Limited (formerly Viagogo Limited)  UKSC 55 provides a forceful restatement by the highest authority in this jurisdiction of the court’s power to grant third party disclosure orders under the principle originally laid down by the House of Lords in Norwich Pharmacal Co v Customs & Excise Commissioners  AC 133.
